Please read these Terms and Conditions ("Terms") carefully before using the services operated by Caribbean International Shipping ("us", "we", or "our"). Your access to and use of our services is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use our services.
Caribbean International Shipping provides logistics and freight forwarding services, including but not limited to: sea freight, air freight, customs brokerage, consolidation, warehousing, and door-to-door delivery ("Services"). All services quoted are subject to the terms and conditions herein.
All quotes provided by us are based on the information provided by you (the "Shipper") at the time of the request. Quotes are valid for a period of 15 days unless otherwise stated. Final charges are subject to change based on the actual weight, dimensions, and nature of the cargo received. Payment is due in full prior to the release of cargo at the destination unless a credit agreement has been established in writing.
The Shipper warrants that they are the owner of the goods or are authorized by the owner to agree to these Terms. The Shipper warrants that all information, descriptions, and documentation provided for the cargo are accurate and complete. The Shipper is responsible for ensuring all cargo is adequately packaged for international transport. We are not liable for damage resulting from improper or insufficient packaging.
When providing customs brokerage services, we act solely as an agent for the Shipper. The Shipper is solely responsible for all duties, taxes, fees, and penalties associated with the import or export of their cargo. Providing incorrect information that leads to customs penalties or delays is the sole responsibility of the Shipper.
Our liability for any loss, damage, or delay to cargo is limited by international conventions (such as the Carriage of Goods by Sea Act - COGSA) and our carrier agreements. Under no circumstances will Caribbean International Shipping be liable for any indirect, incidental, consequential, or special damages, including loss of profits, even if we have been advised of the possibility of such damages. We strongly recommend purchasing separate cargo insurance, which we can help facilitate upon request.
We shall not be liable for any failure or delay in performance of our obligations under these Terms arising out of or caused by, directly or indirectly, forces beyond our reasonable control, including but not limited to: acts of God, war, government actions, port congestion, strikes, weather, or pandemics.
These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or our Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Florida located in Miami-Dade County.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
